§ 1 Subject

(1) The process analysis is a free, automatically generated first assessment of your office processes, based on the information you enter in the form. You receive the report as a web page under a personal link.

(2) The report is generated automatically with AI (Claude, Anthropic) and checked automatically. Some reports are additionally reviewed by a person before they are sent; there is no entitlement to such a review.

(3) These terms also apply to the free 20-minute call-back and to a free test run before a quotation (§ 7).

§ 2 Businesses only

(1) The process analysis is offered exclusively to businesses (entrepreneurs within the meaning of § 14 of the German Civil Code, BGB), including sole traders and freelancers.

(2) By ticking the checkbox you confirm that you request the analysis in the course of your trade, business or profession.

§ 3 No offer, non-binding price information

(1) The report is not an offer within the meaning of § 145 BGB.

(2) Prices in the report are non-binding price information from our catalogue, with a price date. We will make quotations at that price for 30 days after the price date. A price becomes binding only with our written quotation after we have checked scope and capacity; for packages with a guide price, only after a test run with sample data from your field list (§ 7(2)).

(3) Time figures are ranges calculated from your information, subject to the assumptions stated in the report. Relief figures marked “not yet measured” are not substantiated. We do not promise any particular result.

(4) There is no entitlement to a quotation or to a contract.

§ 4 No legal or tax advice

(1) The analysis is a technical and organisational first assessment, not legal or tax advice. We do not check whether your processes meet legal, tax or data-protection requirements, and we do not assign accounts to receipts.

(2) Questions with a legal or tax dimension are listed in the report as open questions for your tax adviser or lawyer.

(3) Please check figures and statements before you base decisions on them.

§ 5 Your information

(1) Please provide accurate information. Do not enter names or other data of other persons, or health data, in free-text fields.

(2) We do not pass your name, company, email address or telephone number to the AI model. Text you enter in free-text fields is processed by the model after recognisable contact data has been masked automatically; in the process, data is transferred to Anthropic in the USA. Details are in the privacy policy.

(3) For each confirmed email address we produce one report and one corrected version within 30 days.

§ 6 Scope and availability

(1) There is no entitlement to a report, to particular content or to a particular time. We may decline or stop producing a report, in particular in case of misuse, implausible information, exhausted capacity or requests outside our catalogue.

(2) Instead of the full report we may send a short version based on your information. Reports that undergo an additional review normally reach you within two working days.

(3) If your request does not fit our catalogue, the report says so and explains why.

§ 7 Call-back and test run

(1) We offer the free call-back (up to 20 minutes) at fixed times and in limited numbers; there is no entitlement to an appointment. We use your telephone number only for this call-back.

(2) A free test run may take place before a quotation. It works with sample data we generate from your field list (column names and formats only, no real data). We tell you the result. The test run does not oblige either party to enter into a contract.

§ 8 Liability

(1) We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the German Product Liability Act, to the extent of any guarantee we have given, and for fraudulent concealment of a defect.

(2) Otherwise our liability is excluded, including for simple negligence.

(3) Paragraphs 1 and 2 also apply to our vicarious agents. The statutory burden of proof remains unchanged.

§ 9 Use of the report

You may use, store and print the report for your business and pass it on to your staff and advisers. Publication or commercial disclosure to third parties requires our consent in text form.

§ 10 Follow-up emails and objection

(1) After the report we send you at most two follow-up emails within 30 days about the package recommended in the report, and only about our own similar services.

(2) You receive further information by email only if you have ticked the separate box. The analysis does not depend on it.

(3) You may object at any time to the use of your email address for these follow-ups, via the link in every email or by email to kontakt@dargel-solutions.de, at no extra cost to you. The objection takes effect immediately; your report remains available.

§ 11 Storage and deletion

(1) We delete unconfirmed requests after 7 days and the report and your information after 90 days. If you have requested a quotation or a call-back or concluded a contract, the periods for pre-contractual dealings and the statutory retention obligations apply; we delete your telephone number after the call-back, at the latest after 30 days.

(2) You can have the report and your information deleted earlier at any time via the deletion link in the report. Details, including retention by the AI provider, are in the privacy policy.

§ 12 Final provisions

(1) German law applies.

(2) The version you accepted when requesting the analysis applies. In case of discrepancies between the German and the English version, the German version prevails.
